By using this website or engaging Softowera for any service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are acting on behalf of a company, you represent that you have the authority to bind that company to these Terms.

Softowera provides the following professional digital services:

Website Development — modern, high-performance websites and web applications.
Custom Web Applications — scalable and secure business solutions tailored to your needs.
WordPress Development — feature-rich WordPress websites and plugins.
Shopify Development — e-commerce stores and custom Shopify solutions.
Graphic Design — branding, UI/UX, and visual content for digital and print.
Website Maintenance & Support — ongoing updates, security, and optimization.
App Development — native and cross-platform mobile applications.
SEO Services — data-driven strategies to improve search engine visibility.

The scope, deliverables, and timeline for each project are agreed upon separately through a project brief or formal contract.

All pricing is agreed upon before project commencement. The following payment terms apply:

A deposit (typically 50%) is required before work begins on any project, unless otherwise agreed in writing.
The remaining balance is due upon project completion and before final file delivery.
All payments are non-refundable once work has commenced, except as described in our Refund Policy.
Invoices not paid within the agreed timeframe may attract a late fee or result in project suspension.
Softowera reserves the right to revise pricing for new projects or scope changes at any time.

Each project includes a defined number of revision rounds as agreed in the project brief. Additional revisions, feature requests, or changes to the original scope may incur extra charges. Softowera will notify you of any additional costs before proceeding with out-of-scope work.

Upon receipt of full payment, the client receives ownership of the final deliverables as specified in the project agreement. However:

Softowera retains the right to display completed work in our portfolio, on our website, and across social media for promotional purposes — unless the client explicitly requests confidentiality in writing.
All underlying tools, processes, proprietary frameworks, methodologies, and software used by Softowera remain the exclusive property of Softowera.
Source code, working files, design assets, or project documentation are transferred only if specifically agreed upon and may be subject to additional fees.
Any third-party assets, plugins, themes, fonts, APIs, or software used in a project are subject to their respective license terms.

To ensure timely and successful project delivery, clients are responsible for:

Providing accurate, complete, and timely project requirements, content, materials, and feedback.
Ensuring that any content, logos, images, trademarks, or assets provided to Softowera are owned by the client or properly licensed for use.
Responding to communications, approvals, and review requests within agreed timeframes.
Delays caused by the client may result in revised delivery timelines without penalty to Softowera.

You agree not to use our website or services for any unlawful, harmful, or abusive purpose. Prohibited activities include:

Using Softowera’s services to create content or applications that are illegal, defamatory, obscene, or infringe on third-party rights.
Attempting to reverse-engineer, copy, or resell Softowera’s proprietary processes, frameworks, or deliverables without authorization.
Misrepresenting your identity or providing false information to obtain services.
Interfering with or disrupting the functionality of our website, servers, or service operations.

To the maximum extent permitted by applicable law, Softowera shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website — including but not limited to loss of revenue, data, or business opportunities.

Either party may terminate a project by providing written notice. In the event of cancellation:

The client is liable for payment of all work completed up to the date of cancellation.
Deposits are non-refundable unless Softowera is unable to commence the project.
Softowera reserves the right to terminate services immediately if a client violates these Terms or engages in abusive, fraudulent, or unethical conduct.

These Terms of Service shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts located in Hyderabad, Sindh, Pakistan.

Softowera reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after any such changes constitutes your acceptance of the new Terms.
